Cuadrist – Terms of Service
1. Introduction: These Terms of Service (“Terms”) govern the use of the Cuadrist website (“the Site”) and the purchase of artworks offered by Cuadrist, hereinafter referred to as “the Seller.” By accessing the Site and making a purchase, the user, hereinafter referred to as “the Buyer,” agrees to comply with and be bound by these Terms.
2. Agreement to Terms: By accessing and using the Cuadrist website (the “Site”), you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these terms, please refrain from using the Site.
3. Artistic Creations: All artworks displayed on Cuadrist are the exclusive intellectual property of Cuadrist. Any unauthorized reproduction, distribution, or use of these artworks is strictly prohibited without explicit written consent from Kriti.
4. Purchase Terms:
a. When placing an order on Cuadrist, you affirm that all information provided is accurate and complete. Cuadrist reserves the right to refuse or cancel orders for reasons including, but not limited to, product availability, inaccuracies in product descriptions or pricing, or suspicion of fraudulent activity.
b. The Buyer acknowledges and agrees to a 10-15 day processing time for the delivery of purchased artworks.
c. All transactions require 100% prepaid payment. No orders will be processed without complete payment.
d. The prices displayed on the Site do not include shipping costs. Shipping costs are calculated based on the delivery pincode and will be presented to the Buyer during the checkout process.
5. Pricing and Payment: Prices for artworks are as displayed on the Site. Cuadrist reserves the right to modify prices at any time without prior notice. Payment information provided must be accurate and current.
6. Shipping:
a. Shipping costs are determined by the Buyer’s delivery pincode and will be calculated and presented during the checkout process.
b. The Seller reserves the right to use a reliable shipping method of their choice to fulfill orders.
c. The Seller is not responsible for delays in delivery caused by unforeseen circumstances, including but not limited to natural disasters, public holidays, or shipping carrier issues.
7. No Refund and No Return Policy:
a. All sales are final. The Seller does not entertain returns or offer refunds, except as expressly provided in these Terms.
b. In the event of receiving a damaged or incorrect item, the Buyer must contact the Seller within 5 days of receipt, and the Seller may, at its discretion, provide a replacement or take other appropriate actions.
8. Intellectual Property Rights (IPR):
a. All intellectual property rights associated with Cuadrist, including but not limited to logos, graphics, and content, are the exclusive property of Cuadrist.
b. Unauthorized use, reproduction, or distribution of Cuadrist’s intellectual property is strictly prohibited.
9. Modification of Terms: The Seller reserves the right to modify or update these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Site.
10. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Delhi, India. The parties hereby consent to the personal jurisdiction and venue of these courts.
